The constitutional structures of the European Union have been a central topic in constitutional theory, European law scholarship, and national constitutional law not only since the Lisbon Reform Treaty. Traditional concepts of general state theory and an outdated mindset that still adheres to the categories of nation-state and unbroken sovereignty are no longer adequate to capture the political reality of the intricately intertwined European constitutional union. The outdated terminology of constitutional law must be rethought entirely within the forum of a European constitutional theory. Constitutional theory examines the European constitutionalization process from a cultural studies perspective while also employing a comparative legal approach. It investigates the novel fundamental order of the EU and its diverse interactions.
