The Assembly Act contains a specific set of tools as a special police law to counter dangers arising from assemblies. In the preventive area, this primarily involves registration and permit requirements. While these are constitutionally problematic, they can be interpreted in accordance with the constitution. The author discusses the implications of violations of the registration and permit requirements against the backdrop of a strictly constitutionally compliant interpretation of the law concerning administrative intervention powers and criminal sanctions. Overall, a homogeneous solution is developed, but the need for reform of the right to demonstrate is also clearly highlighted. The work gains current relevance through the examination of the constitutional permissibility of assembly-free zones, known as prohibited areas or pacified districts.
