Most online gambling options are offered by foreign operators, whose services are accessible worldwide due to the internet, including in Germany. In contrast, Germany has a state monopoly that only allows the state itself to organize gambling activities. Any non-state gambling is prohibited and punishable under sections 284 et seq. of the German Penal Code. Additionally, in the former GDR, four licenses were granted to private individuals, the geographical and material scope of which is disputed in the territory of the Federal Republic of Germany. Furthermore, there is the question of how permits from other EU countries are recognized in relation to community law.
