Against the judicial practice of statutory interpretation, the accusation of arbitrariness is often raised, usually without sufficient material basis. Eric Simon therefore undertakes to comprehensively prepare the state of case law regarding the method of norm concretization in the field of criminal law. The author aligns with the classical canon of interpretation and places emphasis on grammatical and historical interpretation, as crucial decisions are made at this stage (interpretation limits, subjective/objective theory). Beyond the canon, the author seeks clues for a method preferred by the judiciary.
