This opportunity is fundamentally granted to every German citizen as a constitutionally protected fundamental right, with each individual deciding how they wish to engage in the economic cycle. The legislator does not differentiate between self-employed and dependent work, as a sign of its democratic understanding and in the spirit of the social market economy. The following paper outlines the process of founding a company using the example of the corporate form of a GmbH (limited liability company).
