The central theme of the contributions in this anthology is the relationship between international intellectual property law, including personality rights, and the currently controversial issue of public domain. The scope of individual intellectual property rights is increasingly criticized, particularly in light of fundamental rights positions. Both the growing globalization and the accompanying dispute over the distribution of rights to knowledge play a key role in this context. The background of this development is primarily evident in the efforts to establish as strong rights as possible, as expressed in the TRIPS Agreement, as well as in European and other international legal harmonization efforts. The effects of international pressure for adaptation in national legal systems are reflected in the increasing convergence of individual rights.
