Abstract: This thesis aims to present the development of the departure from the confidentiality of files in German administration and the emergence of the right to consumer information in Germany. The various interests of consumers, interest groups, and food entrepreneurs as stakeholders in the context of the right to consumer information, as well as the food monitoring authority, will be highlighted. The different norms of official public information in food law will be presented, with a focus on the background and history of § 40 Abs. 1a LFGB and connections to the regulations of the Consumer Information Act will be established. At the end of the thesis, the question will be answered: Is § 40 Abs. 1a No. 3 of the Food and Feed Code a suitable instrument for consumer information?

On September 1, 2012, the law amending consumer information rights came into force. This introduced § 40 Abs. 1a into the Food and Feed Code - LFGB, which has been in effect since 2005. The background is the legislator's intention to improve consumer information rights and to ensure quick and unbureaucratic provision of information by authorities regarding a sufficiently substantiated suspicion of violations of regulations within the scope of the LFGB that serve to protect consumers or ensure compliance with hygiene requirements, and to change the informational basis of consumer decisions. The information provided to consumers must be based on a product-related violation. This violation must not be insignificant or must be a repeated violation.
