The restructuring of companies and the further development of various restructuring instruments is currently a highly relevant and important topic worldwide. The discussions are often triggered by significant economic events that bring insolvency law into the public spotlight. This phenomenon can also be observed in Switzerland and Germany. This work focuses on a comparison between the German and Swiss regulations for the restructuring of a company that are available in the event of insolvency. Furthermore, the author critically engages with the current reform efforts in the field of restructuring law and examines whether the proposals lead to the desired goals and which legal regulations prove to be particularly advantageous.
