The author deals with conflicts of interest among municipal representatives, exploring their causes and examining the legal regulatory methodology—also in light of municipal political aspects—for its sense, purpose, and practicality. Furthermore, the discussions raise awareness among municipal representatives about role-related conflicts of interest. Initially, a condensed overview of the concept of 'interest' is presented as an analytical framework. Subsequently, the author elaborates on the legal and task-related responsibilities, as well as the voluntary work and role understanding of representatives in the municipal political context. In the main part of the work, he focuses on three exemplary conflict situations that can be located in the municipal context. First, the so-called 'Municipal Representation Prohibition' is examined. Following this, the author addresses the prohibition of participation according to Section 16 VgV, a conflict of interest that municipal representatives may encounter in the context of procurement procedures at the municipal level. Finally, he highlights conflicts of interest and duty arising from the dual role of municipal representatives as supervisory board members of municipal enterprises.
