About the Work

With the Capital Investment Act (KAGB), the German government implemented the European directive for the regulation of alternative investment fund managers (AIFM). Since July 22, 2013, the KAGB has replaced the Investment Act (InvG) and presents a unified and comprehensive regulatory framework for investment funds for the first time. In addition to traditional UCITS funds, it also encompasses so-called alternative investment funds (AIF). This means that closed-end funds are now also subject to regulation. Furthermore, the KAGB includes numerous new regulations, for example, in the areas of special fund investors, depositary bank liability, as well as fund types and investment vehicles.
