Mining law has significantly evolved since its enactment 30 years ago through legislation and jurisprudence. This development has been largely driven by the increased integration of mining law with public law, particularly environmental law. Therefore, the second edition has been fundamentally revised. Key focuses include: the introduction of an environmental impact assessment into mining law; the position of landowners in mining law proceedings and mining damage law; regulation of mining projects in spatial planning; water law, nature conservation, and waste law related to mining; legal issues concerning the closure of mining operations and the preparation for subsequent use. The authors have previously written the first edition of the well-regarded commentary on the BBergG in the professional community. They are familiar with the practical and scientific issues of mining law due to their many years of experience.
