The work addresses liability issues related to the duty of supervision, with a particular focus on the duty of supervision in sports clubs. The general part of the work discusses fundamental dogmatic questions regarding the duty of supervision. It presents the system of sections 1308 and following of the Austrian Civil Code (ABGB), thus providing the basic embedding of the duty of supervision within the Austrian legal system. Regarding the structure of the law, it discusses problems related to the subsidiarity of the legal bases for claims, the timing of the viability assessment, and the legal issue of whether insurance can be considered as assets in the sense of section 1310 ABGB. The specific part examines practical questions of the duty of supervision that frequently arise in sports clubs, primarily based on Austrian and German case law. This aims to provide practical assistance in managing the duty of supervision before, during, and after events.
