Injuries to consumers caused by defective products occur repeatedly. Extensive clarifications have already been made in case law and literature regarding civil product liability. However, criminal product liability lags behind. This work addresses the question of whether (possibility) and to what extent (scope) civil law approaches can be transferred to criminal product liability. After a general comparison between criminal law and tort law, the focus will be on the issue of the uniformity of manufacturer obligations, as well as the differences and similarities in establishing causation and attributing liability.
