Criminal justice policy is characterized by a rollback towards prevention and punitiveness. This is exemplified by the discussion surrounding preventive detention, the debate on torture, and the return of a friend-enemy dichotomy in criminal law and state theory discourse. This is further evidenced by the Federal Constitutional Court's acceptance of one-sided penal provisions as constitutionally compliant in light of the increase in far-right demonstrations, even though these provisions fundamentally violate freedom of expression. At the same time, a new pragmatism is observable with plea deals in criminal proceedings, which is rather atypical for the German understanding. Finally, there is an independent third developmental direction resulting from the internationalization of law: the expansion of international criminal law and international criminal jurisdiction.
