In the English civil procedure, there are extensive rights of access to information for the parties within the framework of the disclosure process. In contrast, the introduction of procedural duties of disclosure is largely rejected in the German civil procedure. Verena Brandt compares the possibilities of access to information and evidence in English and German civil proceedings and examines the extent to which German law provides mechanisms that are functionally comparable to the disclosure process.
