International enforcement law is widely regarded as being governed by the principle of territoriality. However, enforcement actions that do not require physical access cannot be clearly localized. Tanja Domej examines, from a comparative perspective, the controversies surrounding the significance of the principle of territoriality for cross-border debt enforcement. She demonstrates that the relevant substantive issues cannot be resolved based on this principle, and that a simple adoption of international civil procedural law concepts for the recognition process does not account for the specificities of enforcement law. Based on an analysis of the jurisdictional interests of the parties involved, she develops perspectives for a stakeholder-oriented design of cross-border enforcement.
