Individuals who have committed offenses due to a severe mental disorder and continue to pose a danger as a result of this disorder can be placed in a secure treatment facility under sections 63 and 64 of the German Penal Code (StGB) for rehabilitation and safety. Currently, approximately 9,000 patients are being treated in forensic psychiatry and psychotherapy clinics in Germany based on section 63 StGB and in rehabilitation facilities based on section 64 StGB. The treatment of patients in secure facilities is regulated by state law, leading to variations in treatment conditions across different federal states. While minimum requirements for the preparation of reports on criminal responsibility and legal prognosis have already been published, there are currently no agreed-upon standards for treatment in psychiatric secure facilities.
