The incompleteness of laws is mostly rooted in the fact that the legislator cannot anticipate all relevant future scenarios at the time of legislation. On the other hand, there are also instances where specific legal questions have been deliberately left open by the legislator, even though the need for regulation was already known at the time of legislation. This phenomenon, known as a "deliberate gap," is the subject of investigation. Methodologically, the deliberate gap is conceptually clarified and categorized within the widespread typology of gaps, while also being distinguished from similarly situated scenarios where the law remains significantly silent. The omission of the regulation of specific legal questions represents an approach that is particularly associated with the historical legislator of the German Civil Code (BGB).
