An insolvency administrator can release assets that burden the insolvency estate. In particular, the release of real estate assets can have implications for a debtor's potential discharge of residual debt. The study first establishes the prerequisites and legal consequences of releasing real estate assets. The focus is on the effects of the release. After the release, the question arises whether it can be reversed by the debtor or the insolvency administrator. What alternatives are available for the debtor whose discharge of residual debt may be jeopardized by the release? Current law does not provide a solution in favor of the debtor to balance the interests of the parties involved. De lege ferenda, consideration should be given to a limitation of liability analogous to Section 1990 of the German Civil Code. This work is aimed at lawyers, insolvency administrators, as well as property and building managers.
