Although the "death of the author" (Roland Barthes) has already been noted and art has been described as a commodity like any other (Boris Groys), copyright continues to maintain a special personal relationship between the work and the creator. This normative requirement for a distinctive creativity is increasingly restrictive from both artistic and economic perspectives. This paper presents an alternative to the conventional personality-based conception of copyright, designed as a pure property right, which would be more open to current forms of creativity and economic circumstances. In the first part of the paper, the straightforward legal implications of the requirement for distinctive creativity regarding the granting and structuring of rights are examined, including an analysis of the limits of the right to quote.
