The restrictive German labor dispute law has been set in motion in recent years by several decisions from the Federal Labor Court (BAG) and the European Court of Human Rights (EGMR). This includes the BAG's decision from June 19, 2007, regarding solidarity or support strikes. Contrary to its previous decisions from 1984 and 1988, such a strike is now to be considered "generally permissible" rather than "usually unlawful." The application of this new jurisprudence in practice is therefore fraught with significant difficulties, as evidenced by the disputes surrounding the legality of air traffic controllers' strikes. At the same time, this decision calls into question previous dogmatic certainties of labor dispute law: the solidarity strike is classified as a coalition-specific activity and is thus subject to the protection of Article 9, Paragraph 3 of the Basic Law (GG). This study will address the implications for German law.
