Genetic testing is playing an increasingly important role in medical diagnostics. For statutory health insurance, this raises the question of whether and to what extent these tests are covered by their obligations. This question cannot be answered generally, but only by considering the type and context of the respective test. Moreover, the complex regulatory framework of the Social Code Book V and the subordinate norms of health insurance law do not always keep pace with medical and technological advancements, leading to legal classification and demarcation issues regarding new diagnostic developments. This is particularly true for genetic tests that are used for therapy planning within the framework of so-called personalized or individualized medicine. Therefore, this area requires special attention.
