"Facts in Law" is a book for both lawyers and philosophers. The legal question regarding a factual occurrence is philosophically underpinned by the question of how to conceive a necessary connection between an event in the world and its description in the factual part of the judgment. The issue of fact-finding in the legal process is philosophically challenging, as the intertwining of reality and normativity, of being and ought, becomes particularly evident here. It is, not least, an ethical question whether the facts that justify a court ruling can indeed be assumed to be true. The process of knowledge acquisition in the courtroom does not meet scientific standards – a courtroom is not a laboratory – and classical theories of science cannot sufficiently justify this variant of truth-finding.
