To ensure effective protection against product piracy in the field of industrial property rights, effective penal provisions are required. However, the legal situation has long failed to meet this challenge, being characterized by dogmatic problems, systematic contradictions, and constitutional frictions. These difficulties arise partly from an uncritically adopted case law of the Reich Court regarding the patent law penal norm, and partly from a confusing arrangement of the penal norms of industrial property protection within ancillary criminal law, featuring partially arbitrary structures of the offense. The aim of this work is to shed light on the dark chamber of the penal provisions of industrial property protection for the first time and to develop a reform proposal that meets both legal and practical requirements.
