Since 2004, statutory health insurance funds only cover 50 percent of the costs incurred by their insured members for artificial insemination measures. These services are limited to individuals who are married to each other. Furthermore, the law ties such entitlement to benefits to the completion of the 25th year of life, thus establishing a minimum age for the insured. The introduction of a 50 percent co-payment has led to a dramatic decline in reproductive medical procedures. Experts estimate that approximately 55 percent of the decline in births in Germany in 2005 can be attributed to the revision of Section 27a of the Social Code Book V. The aforementioned regulations face serious constitutional objections, which are elaborated on in this work. Due to a referral decision from a social court, the Federal Constitutional Court will address this issue.
