The law on legal protection in cases of excessively long court proceedings and criminal investigations has established a compensation claim that applies in all jurisdictions and also to public prosecutors. It is independent of fault, meaning that court overload is not a factor. Therefore, it is part of the legal duty of care to pay increased attention to the duration of proceedings. Lawyers must ensure that claims are raised in a timely manner and formally correct by using the complaint of excessive duration of proceedings.
