The law on legal protection in cases of excessively long court proceedings and criminal investigations has established a compensation claim that applies in all jurisdictions and also to public prosecutors. It is independent of fault, meaning that court overload is not a factor. Therefore, it is part of the legal duty of care to pay increased attention to the duration of proceedings. Lawyers must ensure that claims are raised in a timely manner and formally correct by using the complaint of excessive duration of proceedings. The state and federal government, as the respective defendants, are increasingly confronted with these claims. Judges must adapt to the new requirements, including in formal aspects. The new commentary provides insights into the new sections 198-201 of the GVG and the corresponding provisions in the court regulations.
