Investment advice holds significant importance in Germany, as many consumers lack their own financial knowledge. Therefore, they rely on external advice prior to making investment decisions. The legislator faces the considerable challenge of creating adequate conditions to ensure an appropriate level of consumer protection, while not hindering providers with unnecessary regulations. In this context, the author thoroughly analyzes and evaluates the current tension between the necessary consumer protection on one hand and the risk of overregulation on the other.
