Should civil servants in Germany be allowed to wear headscarves? The state's open neutrality actually supports this. However, some federal states have enacted laws aimed at preventing female civil servants from wearing headscarves due to the Ludin decision. It becomes evident that these laws conflict with constitutional and European law. Subsequently, a proposal for a constitutionally and EU-compliant law will be presented. Additionally, an insight into the Turkish legal situation will be provided. A comparison with Turkey, the country of origin for most headscarf wearers in Germany, shows that Turkey has a different approach to the headscarf. A strictly secular path, in the Turkish sense, is pursued. There is a complete ban on headscarves in public sector jobs. Another focus of the work is the question of whether female employees are allowed to wear headscarves in the workplace.
