The monument protection laws of the federal states impose extensive and sensitive restrictions on the ownership of monuments, creating a constant tension with the constitutionally guaranteed protection of property. This work examines how this conflict between private benefit and public interest can be alleviated within the limits set by Article 14 of the Basic Law. The constitutionally permissible scope of property restrictions under monument protection law is exemplified through key provisions of the Lower Saxony Monument Protection Act (NDSchG). In this context, particular attention is given to the crucial decision of the Federal Constitutional Court (BVerfG) from March 2, 1999, which is essential for property doctrine. The statements made in that decision thus form the constitutional foundation for analyzing the constitutionality of the NDSchG. The investigation concludes that the NDSchG can still be implemented in a constitutionally compliant manner when interpreted restrictively.
