Like few other medical fields, transplantation is heavily dependent on public acceptance. Law plays an important role in its promotion, balancing the various interests of those involved in transplantation. Ethical and legal-political questions need to be clarified. This work presents different legal solutions to the globally similar problems of transplantation medicine using the example of the three neighboring countries: Germany, Austria, and Switzerland. After explaining the medical aspects, ethical and legal-political questions are discussed. The comparison of the legal situation in the three neighboring countries highlights the deficiencies in their respective laws and formulates legal-political demands. Following a brief overview of the European legal situation, a unified solution for Europe is discussed. The results of a personal survey underscore the legal-political demands made.
