The German International Property Law was first codified in 1999. Essentially, the codification aimed to incorporate the existing customary and case law international property law into the EGBGB. It is characterized by the principles of legal certainty and clarity in its connecting factors, following German substantive property law in this respect. Only the escape clause in Art. 46 EGBGB leads to legal uncertainty with its reference to the open concept of a significantly closer connection. The author seeks to clarify the concept of a significantly closer connection and to establish conclusive categories of cases. In this way, the application of Art. 46 EGBGB becomes predictable, and legal uncertainty is eliminated.
