The work deals with the peculiarities of ecclesiastical (particularly Catholic) labor law in the case of the transfer of operations from secular to ecclesiastical entities and vice versa. The discussion begins with an overview of the origin of the churches' privilege to enact their own laws based on Article 137 (3) of the Weimar Constitution. The focus of the analysis is on the depiction of heightened ecclesiastical loyalty obligations, the comparability of collective agreements and ecclesiastical employment contract guidelines, as well as ecclesiastical employee representation rights. The author concludes that § 613a of the German Civil Code (BGB) applies in a modified form to ecclesiastical labor law. An exception is made for § 613a I 2-4 BGB, as ecclesiastical employment contract guidelines, according to the author's findings, do not have normative effect in deviation from collective agreements, making an analogy to § 613a I 2-4 BGB appear impossible. From a collective law perspective, it is determined that operational and service agreements end with the transfer of a secular operation to an ecclesiastical entity.
