In national construction law, the legal protection of third parties affected is one of the central issues. The rigid adherence to the theory of protective norms continues to prevent the necessary justification of legal claims beyond subjective public law. This has almost inevitably led to argumentative breaks in the past and will not withstand a fundamental change in light of the ongoing Europeanization. The aim of this work is to illustrate the effects of advancing Europeanization on construction neighbor law against the backdrop of the issues surrounding subjective public law. After a review of the development of subjective public law and its significance for national construction law, a comparative reference is made to the French and European legal protection systems. This is followed by a presentation of the doctrinal integration of community legal claims into German administrative procedural law. The consequences for administrative procedural law and specifically for national construction law are then discussed. Ultimately, this work concludes that it can be considered established that an expansion of access to courts is to be expected for public construction law, and the difficulties of subjective public law can be overcome with multipolar relationships.
