Consumers are repeatedly confronted with evidentiary issues in product liability proceedings. This is particularly true with regard to the proof of defect and causation. The aim of this work is to find suitable solutions to improve this issue. A total of four different proposals are examined: the introduction of a reduction in the burden of proof, a reversal of the burden of proof, a right to information, and a regulation for the manufacturer to cover expert costs in product liability law. The proposals are analyzed in terms of teleological, dogmatic, and legal aspects. A crucial criterion for the assessment is primarily the preservation of a fair balance between manufacturer and consumer interests.
