The work compares settlement processes in Germany and Poland. It focuses on the legal nature and the interaction between the court and the parties involved in the settlement process, particularly regarding practicality and procedural economy within the respective civil procedure codes. The study examines the conditions for effectiveness, consequences, and deficiencies of the settlement process from a comparative legal perspective. As a result, the settlement process in Poland, contrary to common belief, can conclude the proceedings even without a dismissal order and is immediately enforceable. A conditional settlement is permissible under Polish law and should be accepted in court practice. When asserting defects of consent, the rules of substantive law apply in both legal systems.
