The author examines the justification of the sentencing decision in the judgment as the most relevant part for the defendants. There is hardly any other area of criminal law that offers the trial court as much discretion. Therefore, the justification for sentencing in the judgment primarily serves the purpose of enabling oversight of this decision while also achieving the acceptance of the defendant. The author investigates what requirements should be placed on this obligation to provide justification in light of these and other purposes, as well as due to statutory and, above all, appellate court guidelines regarding scope and extent, within the framework of this book, critically reviewing any potential limitations by referring to Section 267 III 1 HS 2 of the Code of Criminal Procedure.
