For a long time, legal scholars have been concerned with the issue of whether and to what extent the liability of minors should be limited for their protection. On January 1, 1999, the Minor Liability Limitation Act came into effect. The study discusses whether the law meets the requirements set forth by the Federal Constitutional Court's ruling on May 13, 1986, regarding the re-regulation of minor protection, particularly concerning the economic activities of minors as sole proprietors or partners in a partnership. The law is critically evaluated, deficiencies are identified, and proposals for amendments to improve the legislation are presented.
