In a medical treatment, even the smallest oversight or slightest inattention can lead to the criminal liability of the doctor for negligent homicide or negligent bodily harm. Particularly in light of the significant risk propensity of medical practice and the pressure towards defensive medicine, this is worth reconsidering. The work addresses the question of whether and to what extent a limitation of criminal liability should be considered and develops a proposal for the legislator.
