Since the decision of the European Court of Justice in the Albron Catering case, there has been increased uncertainty regarding the legal consequences of the transfer of a business that also employs temporary workers: Does the relationship between the lending transferor and the temporary worker transfer to the business acquirer according to § 613a BGB? Does the temporary worker transition into a permanent employment relationship with the business acquirer? Or does the employment relationship that has transferred to the business acquirer also include the temporary employment relationship? How does this end if it is not transferred? This work provides answers to these controversially discussed questions in the literature for both European and German law and outlines a coherent overall picture.
