In the member states of the European Community, services can be provided across borders. This often involves sending workers to another state, where the respective working conditions represent a crucial competitive factor. In recent years, the posting of workers within the European Community has been regulated by the so-called Posting Directive as well as by national posting laws. The work analyzes the different regulations against the backdrop of their European legal and conflict-of-laws implications. The focus of the investigation is on the systematic interactions between the existing conflict-of-laws agreements and the new regulations. The study concludes that the posting laws, in their fundamental orientation, unlawfully restrict the fundamental freedoms.
