The work initially examines the circumvention of laws through case studies, focusing on the characteristic of intent to circumvent. Based on current methodological principles, a testing framework is developed to facilitate a systematic approach to the circumvention of laws. Following this, the European guidelines regarding circumvention are analyzed to derive the conditions for a general prohibition of circumvention, referencing the case law of the European Court of Justice (ECJ).
