The chosen property regime of community of property has lost significance in recent decades and is rarely agreed upon anymore. In legal literature, there are even calls to abolish it. This work addresses the individual points of criticism and compares the advantages and disadvantages of community of property with those of the statutory property regime of the community of accrued gains. It demonstrates how the shortcomings of community of property can be remedied through property law agreements or legislative changes. The proposals are based on the regulations of other EU member states that recognize a property regime similar to community of property in the form of the community of acquired gains as a statutory property regime. In this way, it contributes to the harmonization of property law.
