The work analyzes a model of the doctrine of concealed contributions in kind, which primarily corresponds to developments in community partnership law. The study provides an overview of the German and community legal foundations of capital contribution law. The norms of the Capital Directive are examined in depth, leading to the conclusion that the fundamental idea of the Capital Directive lies in ensuring the actual provision of capital. The minimum standard character of the Capital Directive is established. If the minimum protection standard is adhered to under community partnership law, there is no circumvention of the law. Therefore, a community law doctrine of concealed contributions in kind cannot be established. Such a doctrine could be achieved by borrowing the concept of concealed contributions in kind from German law and appropriately adapting it to apply to community partnership law.
