The subject of this work is the presentation of the structures of Austrian and German association law in their integration into FIFA and UEFA, as well as the respective national association regulations regarding the restrictions on the use of non-native players and payment obligations in player transfers based on the Bosman ruling. As will be demonstrated, seemingly purely national regulations can also conflict with community law and therefore may not be applicable to cross-border matters. The focus will primarily be on professional sports, as this area must particularly align with the guarantees of community law. In the first step, the association structures in Austria and Germany, as well as the relevant association regulations up to the Bosman ruling, will be presented. This will be followed by an examination of the statements of the ruling and its impact on the two national associations. The main part of the work is dedicated to the question of whether the community law requirements of the European Court of Justice have been properly implemented in Austrian and German association law in the meantime, as well as addressing unresolved issues.
