In recent years, telemedicine has increasingly been the subject of medical and legal discussions. This work therefore examines the extent to which teleconsultation, teleconsultation, and teleoperation can be reconciled with the professional legal principle of personal service delivery and the so-called prohibition of remote treatment enshrined in the medical professional code. The author proposes a revision of the currently overly restrictive § 7 para. 3 of the model professional code for physicians, considering the potentially beneficial and sensible application of telemedical methods for the patient in individual cases. Furthermore, the author highlights the liability issues that arise specifically within the framework of telemedicine and demonstrates that these can be resolved using the general principles of medical liability developed by the judiciary.
