This book provides an overview of the obligation to monitor products. To fulfill this obligation, measures to mitigate risks, particularly warnings and product recalls, are considered. In addition to the doctrinal foundations, the author also addresses the nature and extent of potential consequences arising from a violation of the product monitoring obligation or the U.S. post-sale duties. Against this background, differences as well as similarities between both legal systems in this area of product liability law are explained. Ultimately, at least a warning about product dangers should be issued, while the recall of the product should remain the ultima ratio and not become the norm.
