With the law to strengthen recovery assistance and asset confiscation in criminal offenses dated October 24, 2006, the legislator revised the paragraphs 111 b et seq. of the Code of Criminal Procedure (StPO) and introduced the state's acquisition of residual rights for the first time. In the interest of effective victim protection, the rights of victims of property crimes are to be further strengthened and existing regulatory gaps closed. At the same time, the introduction of the residual rights acquisition, in line with the principle that "crime must not pay," aims to ensure a comprehensive confiscation of criminal profits. The author examines, through a comprehensive analysis of the provisions of paragraphs 111 b et seq. of the StPO and the changes made, to what extent the legislator has succeeded in this endeavor.
