Due to the extensive freedom of contract in the law of silent partnerships, a highly differentiated type of partnership has developed. This has implications for the silent contribution, which can only be classified as either equity or debt capital based on its specific contractual design - with significant consequences in the event of insolvency, which are discussed in detail. The work systematically addresses all essential questions that arise in the insolvency of one of the partners in the silent partnership. It also discusses the peculiarities of the grounds for insolvency and the challenge of insolvency, as well as the implementation of the settlement process.
