Since the enactment of the Bavarian Constitution, scholars and politicians have been discussing the permissibility and the prerequisites for a constitutional amendment by the people. This work concludes, through an examination of the wording, historical development, systematics, and teleology of the Bavarian Constitution, that a direct democratic constitutional revision is possible even without the involvement of the state parliament. However, the Constitution largely leaves the determination of the majority required for a constitutional amendment referendum to the ordinary state legislator.
