In liability insurance, the AHB (General Terms and Conditions) form the basis of the respective contracts. However, for decades, there has been controversy over which event is decisive for the temporal delimitation of insurance coverage in § 1 No. 1 AHB. Is it the violation committed by the policyholder or the event that directly leads to the damage? The author points out that this question overlooks essential aspects. § 1 No. 1 AHB violates the transparency requirement enshrined in § 9 para. 1 of the General Terms and Conditions Act in several respects. Furthermore, the principle of violation or the consequential event is generally not suitable for achieving a balance of interests in general liability insurance. However, this can be addressed by introducing a claims-made principle in the AHB.
